Terms of service

    1. General Provisions

    1.1. The online store BIKSUBAZE.LV of SIA Graudu Lietus is a distance shopping system website – www.biksubaze.lv (hereinafter – BIKSUBAZE.LV), which provides the opportunity to view the goods offered by “Graudu Lietus” SIA, registration No. 40103425330, Bumbieru Street 11, Stopiņi, LV-2130, phone 29297999, email veikals@biksubaze.lv (hereinafter – SIA “Graudu Lietus”) and to place orders for them.

    1.2. Any person (hereinafter – the Customer), by placing an order for goods available on BIKSUBAZE.LV (hereinafter – the Order), confirms that they have read and undertake to comply with these terms and the usage descriptions of BIKSUBAZE.LV. By placing the Order, the Customer confirms that they have become acquainted with the information regarding their rights, the conditions for exercising such rights, the terms and procedures, which together form an integral part of these terms.

    1.3. The acceptance, processing and fulfilment of Orders for goods available on BIKSUBAZE.LV is ensured by SIA “Graudu Lietus”.

    1. Placing and Receiving an Order

    2.1. By placing an Order on BIKSUBAZE.LV, the Customer confirms that they have read the description of the selected product and that it meets the Customer’s requirements and needs.

    2.2. When placing an Order, the Customer undertakes to provide accurate personal data necessary for the fulfilment of the Order, the delivery address and contact information. In the event of inaccurate data, the Order will not be fulfilled.

    2.3. The Customer agrees to the processing of their personal data, including personal identification codes, and the use of technological solutions in order to ensure the fulfilment of the Order, administration of payments, offering of goods or services, review of claims and fulfilment of warranty obligations in accordance with applicable laws and regulations.

    2.4. When placing an Order, the Customer independently saves the documentation related to the Customer’s Order. Information about placed Orders is not stored permanently in the BIKSUBAZE.LV environment.

    2.5. After the Order has been placed and the Customer’s confirmation of having read these terms and other binding documents has been received, an automatic email confirming receipt of the Order application is sent to the email address specified in the Customer’s application. This email is for informational purposes only.

    2.6. If the Customer’s Order is available on BIKSUBAZE.LV and can be fulfilled, the Customer will be informed within 1 (one) business day from the moment of receiving the Order application, by email or phone, about the availability of the Order and the delivery terms.

    2.7. Delivery of the Order is ensured within 1–3 (one to three) business days after the Order has been confirmed and payment has been received in the account specified on the invoice.

    2.8. The Order is considered confirmed when BIKSUBAZE.LV receives correct personal data of the Customer, the delivery address and contact information.

    1. Prices and Payment Procedure

    3.1. By placing an Order on BIKSUBAZE.LV, the Customer agrees to the price of the selected product and the payment procedure.

    3.2. The prices of goods and services on BIKSUBAZE.LV are indicated including taxes, including value added tax. The fee for Order delivery, if applicable, is determined separately according to the delivery fees of BIKSUBAZE.LV.

    3.3. The Customer pays for the Order by bank transfer to the bank account specified on the invoice within 2 (two) business days after receiving the invoice.

    1. Product Quality and Warranty Obligations

    4.1. The warranty does not apply and/or the Customer’s claim will not be satisfied if:

    4.1.1. the defect has occurred as a result of natural wear and tear of the product or the product has a limited service life arising from the intended use of the product or its part;

    4.1.2. the Customer fails to comply with the product usage rules and the rules specified in the manufacturer’s instructions;

    4.1.3. the Customer cannot present a document confirming the purchase of the product – the delivery note-invoice.

    4.2. The Customer has the right to exercise consumer rights provided by applicable laws and regulations for submitting claims. All disputes related to the fulfilment of the Order shall be resolved through negotiations. If an agreement cannot be reached, the dispute shall be resolved in accordance with the procedures established by the laws and regulations in force in the Republic of Latvia, where necessary by using an out-of-court consumer dispute resolution body – the Consumer Dispute Resolution Commission. www.ptac.gov.lv.

    4.3. If the Customer submits a claim regarding a possible defect in a product purchased within the Order, the product may be sent for inspection to a manufacturer-certified service centre in order to determine the type of defect: a manufacturer’s defect or a defect that occurred after the product was handed over to the Customer.

    1. Returns

    5.1. The Customer has the right, within 14 (fourteen) days from the moment of delivery of the Order and by agreement with a representative of BIKSUBAZE.LV, to exchange the product for another product, if such product is available on BIKSUBAZE.LV, or to return the product if:

    5.1.1. the product has not been used, the product packaging has been preserved and is not damaged;

    5.1.2. the Customer has the product delivery note-invoice and the product is complete;

    5.1.3. the Customer covers the costs related to returning the product;

    5.3. If the Customer wishes to exchange or return the product, a representative of BikšuBāze.lv has the right to ask the Customer to provide the reason for returning the product and then carry out the exchange or accept the returned product;

    5.4. Within 14 (fourteen) days after receiving the product, BikšuBāze.lv refunds the payment for the product to the Customer’s account from which the Customer made the payment for the Order;

    5.5. The Customer has the right to request that their existing data be supplemented, corrected, and that data processing be stopped or the Customer’s data be deleted if it is outdated, incomplete or no longer necessary for the original purpose of collection. Such information requests should be sent to the specified email address: veikals@biksubaze.lv.

    1. Delivery

    6.1. Delivery of goods via “OMNIVA” parcel terminals:

    6.1.1. The service is subject to a fee according to the price list of the service provider Omniva;

    6.1.2. The person placing the Order is responsible for providing accurate and complete data. The delivery address of the product is agreed upon during the Order placement process. If repeated delivery or delivery to another address is required, the delivery service fee is applied as for a new service;

    6.1.3. Delivery of goods is carried out within 3 (three) business days from the moment confirmation of invoice payment is received;

    6.1.4. One copy of the delivery note-invoice is attached to the product.

    6.2. Collection of goods at the “Bikšu Bāze” store, Kvēles Street 41, Riga:

    6.2.1. Collection of goods at the store is a free service;

    6.2.2. Goods are issued only to the person who placed the Order. Goods are issued if the Customer presents a personal identification document.
