1. GENERAL TERMS
1.1. SIA Graudu Lietus, legal address: Bumbieru iela 11, Stopiņu novads, LV-2130, company registration number: 40103425330, brand names: “Bikšu Bāze” and “Bikšu Bāzes Garderobe”, hereinafter referred to as “BikšuBāze”, undertakes to protect its customers’ personal data in accordance with applicable data protection laws. This Privacy Policy describes how we collect, process and protect our Customers’ personal data when they visit the BikšuBāze Website and/or purchase BikšuBāze Goods.
2. DATA WE MAY COLLECT
2.1. BikšuBāze may collect and process the following data:
2.1.1. Personal data provided by the Customer when placing an order for Goods or submitting a request for an offer on the Website. BikšuBāze may also ask the Customer for personal data when the Customer reports a problem with the Website;
2.1.2. A record of correspondence if the Customer contacts BikšuBāze by email, SMS, WhatsApp, etc.;
2.1.3. A record of conversations for training purposes if the Customer contacts BikšuBāze;
2.1.4. In the case of surveys, BikšuBāze may ask the Customer to voluntarily answer questionnaire questions, which are used to prepare an offer for the Customer or for research purposes;
2.1.5. detailed information about the Customer’s transactions carried out on the Website and about the fulfilment of orders;
2.1.6. detailed information about the Customer’s visits to the Website, including, but not limited to, traffic data, location data, web logs and other communication data.
3. PURPOSE OF DATA PROCESSING
3.1. We use Customer data for the following purposes:
3.1.1. to register the Customer and provide access to the BikšuBāze Website, to ensure payment options for the ordered Goods and to deliver the ordered Goods;
3.1.2. to ensure that the content of the Website is displayed effectively and in accordance with the Customer’s computer settings;
3.1.3. to provide Customers with information about available Goods that may be of interest to them, if the Customer has agreed to receive such information;
3.1.4. to fulfil BikšuBāze’s obligations arising from all contracts concluded between the Customer and BikšuBāze;
3.1.5. to allow the Customer to use the interactive features of the BikšuBāze Website, if the Customer wishes to do so;
3.1.6. to inform the Customer about changes to the Website.
4. IP ADDRESSES AND COOKIES
4.1. In order to analyse Customer visits to the Website, BikšuBāze also collects cookies (files stored locally on the Customer’s device). By enabling cookies in their browser, the Customer agrees that we may collect cookies for the purpose stated above. BikšuBāze uses the following types of cookies: (i) essential cookies, which are necessary to provide access to the BikšuBāze Website; (ii) functionality cookies, which are necessary for the proper operation of the BikšuBāze Website (if these cookies are disabled, the BikšuBāze Website may not function properly); (iii) performance cookies, which do not identify the Customer until the Customer enters their identification information in one of the BikšuBāze forms, but help personalise the content shown to the Customer according to the Customer’s activities on the BikšuBāze Website; and (iv) targeting/advertising cookies, which help tailor advertisements to visitors of the BikšuBāze Website.
4.2. BikšuBāze also uses Google Analytics, Facebook Pixel and similar services that collect third-party cookies (“Third-Party Analytics Programs”). Cookies generate information about the use of the Website, including the Customer’s IP address, which Third-Party Analytics Programs may transmit to and store on servers in the USA. Third-Party Analytics Programs use this information to evaluate how the Customer uses the Website, to prepare reports on activities carried out on the Website and submit them to the Website operators, and to provide other services related to Website activity and internet usage. Third-Party Analytics Programs may also transfer this information to third parties where required by applicable law or where such third parties process the information on behalf of the Third-Party Analytics Programs. Third-Party Analytics Programs do not associate the Customer’s IP address or other cookies with other data. The Customer may refuse the use of cookies by selecting the relevant browser settings; however, in such case, it may not be possible to use all features of the Website. By using the BikšuBāze Website, the Customer agrees that Third-Party Analytics Programs process the Customer’s data in the manner and for the purpose described above. 4.3. The Customer may stop the collection of cookies by resetting their browser; in such case, the operation of the BikšuBāze platform may be restricted (for example, disabling essential cookies may prevent access to the BikšuBāze Website).
4.4. The BikšuBāze Website and communications generated through the Website and/or through the purchase of BikšuBāze Goods, for example advertising emails, may contain electronic images known as “web beacons”. Web beacons usually function together with cookies, and BikšuBāze may use them in the same way as cookies (see above).
5. DIRECT MARKETING
5.1. The Customer agrees that BikšuBāze may use the Customer’s electronic contact information, which may be obtained from the Customer’s previous visits to the Website, to contact the Customer electronically (by email, SMS or WhatsApp message) and inform them about goods and services. The Customer may opt out of marketing communications and disable this function by using the unsubscribe link included in each received email.
6. DATA SHARING
6.1. By clicking the “I agree” button and placing the relevant order for Goods, the Customer agrees to the transfer of their personal data to third parties - partners that provide services necessary for the performance of the Contract, such as delivery and payment service providers - and agrees that these parties will act as processors of the Customer’s data (“Processors”). All Processors are available on the BikšuBāze Website, and the Customer agrees that the Processors may obtain, collect, distribute, record, organise, adapt or modify, retrieve, review, align, combine, transmit, use, store, block, destroy and manage cross-border flows of personal data.
6.2. BikšuBāze may share your data if applicable law specifically permits the disclosure of personal data.
7. DATA STORAGE AND SECURITY
7.1. BikšuBāze undertakes to store the Customer’s data securely within the European Economic Area (“EEA”). For this reason, BikšuBāze implements and continuously improves physical, technical and organisational measures and plans to ensure the protection and security of the data collected about Customers. However, these measures do not release the Customer from the obligation to take the actions necessary to protect their own data, especially during data transmission. BikšuBāze’s aim is to prevent unauthorised or unlawful processing of Customers’ personal data or accidental, unauthorised or unlawful access to the Customer’s data, as well as its use, transmission, processing, copying, further disclosure, modification, loss or damage. BikšuBāze is not responsible for the security of Customer data if it is transmitted or further disclosed in an insecure manner.
7.2. If BikšuBāze gives the Customer, or the Customer chooses, a password to access certain pages of the Website, the Customer is responsible for keeping this password confidential. BikšuBāze asks that the password not be disclosed to anyone.
7.3. Since the exchange of information on the internet is not completely secure, BikšuBāze undertakes to do everything possible to protect Customer data; however, it cannot guarantee the security of data transmitted on the Website - the Customer assumes full responsibility for transmitting their information. After receiving the Customer’s data, BikšuBāze applies strict procedures and security measures to prevent unauthorised access.
8. CUSTOMER RIGHTS
8.1. When placing an order or applying to receive an offer, the Customer may request that the data disclosed about them be edited or deleted (except for billing data, which cannot be edited due to payment processing requirements). The Customer may fully cancel their registration, request changes to their data, or opt out of any marketing communication carried out by BikšuBāze or any third party by sending an email to veikals@biksubaze.lv.
8.2. The Customer has the right to request that their personal data not be processed for marketing purposes. BikšuBāze informs the Customer before collecting data if it plans to use the Customer’s data or disclose the Customer’s information to any third party for marketing purposes. The Customer may exercise their rights at any time by sending an email to veikals@biksubaze.lv.
8.3. The Customer has the right to access the information held by BikšuBāze about the Customer. The Customer’s right of access is exercised in accordance with applicable law. If the Customer’s requests are manifestly unfounded, excessive or repeated, BikšuBāze may:
8.3.1. charge a reasonable fee, taking into account the administrative costs of carrying out the requested actions; or
8.3.2. refuse to comply with your request.
8.4. If the BikšuBāze Website contains links to and from websites of partner networks, advertisers and affiliates, please note that each of these websites has its own privacy policy and that BikšuBāze assumes no responsibility or liability for these policies if the Customer clicks on any of the links. Before submitting your personal data on these websites, please read their privacy policies.
8.5. BikšuBāze processes your information in accordance with Section 7 of these Terms. By using our Website and/or concluding a Contract, the Customer agrees to such processing and confirms that all data provided is correct.
8.6. If you believe that your data has been processed unlawfully, we invite you to contact us at veikals@biksubaze.lv, and we undertake to handle this situation responsibly.
